Rental Agreement
1. Parties
This Rental Agreement (“Agreement”) is between:
ThrowbackCam™ (“Lessor”) and The customer completing the booking (“Lessee”)
By booking, paying, or using the equipment, Lessee agrees to all terms below.
2. Equipment Provided
Lessor rents retro camcorder equipment (“Equipment”) for use at weddings, parties, graduations, corporate events, and other celebrations.
Equipment may include:

Camcorder
-
Battery
-
Charger
-
Memory card
-
Carrying case
3. Rental Period
The rental period begins when the Equipment is delivered or picked up and ends when it is returned to Lessor.
Late returns may incur a daily late fee. If not returned within 10 days, the Equipment is considered lost and charged at full replacement value.
4. Payment

Payment is due in full at booking.

All payments are non‑refundable.

Booking is not confirmed until payment is received.
5. Use of Equipment
Lessee agrees to:

Use the Equipment safely and responsibly
-
Keep Equipment away from water, sand, extreme heat, and impact
-
Use only the accessories provided
-
Not attempt repairs or modifications
-
Not allow minors to operate the Equipment
6. Damage, Loss & Replacement
Lessee is responsible for the Equipment from delivery/pickup until return.
Lessee will be charged for:

Damage
-
Loss
-
Theft
-
Water damage
-
Cracked screens
-
Broken buttons
-
Missing accessories
-
Dirty or sticky returns (cleaning fee)
Replacement cost: up to $700 depending on model.
Lessor may charge the card on file for repair or replacement.
7. Footage Ownership & Editing

All footage recorded is transferred to Lessor for editing.

Lessee receives full rights to the final edited video.

Lessor will never use footage for marketing without permission.

Raw footage may be deleted 30 days after final delivery.

Lessor is not responsible for:
-
Guest filming errors
-
Poor lighting or audio
-
Missed moments
-
Corrupted files
-
Unusable footage
-
8. Editing Timeline
Final edited videos are delivered within 7–14 business days after Equipment is returned.
Rush editing may be available for an additional fee.
9. Non‑Working Equipment
If Equipment appears non‑functional upon receipt:

Lessee must notify Lessor immediately

Lessee must not attempt repairs
-
Lessor will replace the Equipment or issue a refund if malfunction is not caused by misuse
10. Liability
Lessor is not liable for:
-
Missed moments
-
Guest misuse
-
Event delays
-
Weather
-
Venue restrictions
-
Data loss
-
Corrupted files
-
Any indirect or consequential damages
Maximum liability is limited to the amount paid for the rental.
11. Indemnification
Lessee agrees to indemnify and hold Lessor harmless from any claims arising from use of the Equipment.
12. Governing Law
This Agreement is governed by the laws of the State of Texas, with venue in Dallas County.
